Terms of Use

These Terms of Use ("Terms") govern access to and use of RetoraLab (the "Service"). By using the Service, you agree to these Terms.
1. Operator
The Service is operated by:

2. Scope and user categories
These Terms apply to:
- Consumers, meaning natural persons acting outside a professional or commercial capacity.
- Business users (B2B), meaning companies, organisations, public bodies, or individuals acting in a professional capacity.
Additional or different terms may apply to B2B users under a separate written agreement. In case of conflict, the written agreement prevails.
3. Description of the Service
- RetoraLab provides AI-powered tools to test and explore reactions to messages using simulated personas and cohorts.
- Personas and cohorts are artificial constructs, not real individuals.
- Outputs represent non-binding, indicative reactions, not facts, predictions, advice, or instructions.
- The Service supports exploratory and analytical use only.
4. Accounts and responsibility
- You are responsible for all activity under your account.
- You are solely responsible for all inputs, including messages, prompts, documents, uploads, and other data you submit.
- You must ensure that your inputs comply with applicable law and these Terms.
- We do not verify, endorse, or validate user inputs.
5. Acceptable use
You agree to use the Service lawfully, ethically, and responsibly.
You must not use the Service in ways that create legal, ethical, societal, or reputational risk.
6. Prohibited uses
The Service must not be used for:
- hate speech, harassment, or discrimination,
- disinformation, misinformation, or deceptive advocacy,
- covert persuasion, manipulation, or psychological exploitation,
- voter suppression, election interference, or unlawful political influence,
- messaging intended to intentionally mislead audiences as to facts, intent, or sponsorship,
- coordinated or concealed influence campaigns,
- any use that we reasonably consider morally unacceptable or socially harmful.
This list is not exhaustive.
7. Political and advocacy-related use
- Political or public-affairs use is allowed.
- However, the Service must not be used for deceptive, covert, or manipulative political messaging.
- We assess such use case by case and reserve full discretion to restrict access.
8. Interaction with personas and cohorts
- The Service may include chat-based or interactive features with personas or cohorts.
- Responses generated by personas or cohorts:
- are fully AI-generated,
- are provided for exploratory purposes only,
- do not represent facts, opinions, advice, or positions of real persons or groups.
- We assume no responsibility or liability for persona or cohort responses, their content, tone, or implications.
- You remain solely responsible for how you interpret or use such responses.
9. Suspension, termination, and enforcement
We may, at our sole discretion and without prior notice:
- suspend or restrict access,
- terminate accounts,
- remove content,
- downgrade accounts,
- refuse current or future use,
if we believe that:
- these Terms are violated,
- the Service is used in a prohibited or unethical manner,
- continued access creates legal, ethical, or reputational risk.
No refund is due in case of termination or suspension for breach.
10. Plans, downgrading, and termination effects
Downgrading to free tier
If a paid account is downgraded to a free tier:
- access to historical data, records, and outputs may be limited,
- only the most recent 3 months of data may remain accessible,
- older records may become inaccessible or deleted.
Data access and export
- Data download may be requested while you are a paid user or within the above 3-month period.
- Data export may be subject to a fee.
- After this period, we do not guarantee retention, availability, or access to user data or records.
11. Data use and privacy
- You retain ownership of your content.
- You grant us a limited, non-exclusive right to process content solely to operate and maintain the Service.
- We may use usage data and content only in aggregated or anonymised form to improve the Service.
Personal data is processed in accordance with our Privacy Policy, which forms an integral part of these Terms.
Enterprise customers may request enhanced data controls or opt-out options under a separate agreement.
12. Intellectual property
- The Service, software, interfaces, models, and branding remain our intellectual property.
- You may not copy, reverse engineer, or exploit the Service beyond its intended use.
13. Disclaimers
- The Service is provided "as is" and "as available".
- We make no guarantees regarding accuracy, completeness, or fitness for a specific purpose.
- Outputs must not be relied upon as legal, political, professional, or strategic advice.
14. Limitation of liability
To the maximum extent permitted by law:
- we are not liable for indirect, consequential, or reputational damages,
- total liability is limited to fees paid in the 12 months preceding the claim.
Nothing limits liability where exclusion is not permitted by law.
15. Governing law and jurisdiction
- These Terms are governed by the laws of Hungary.
- Hungarian courts have exclusive jurisdiction.
- Arbitration may be agreed separately in writing.
16. Changes to these Terms
We may update these Terms from time to time.
Continued use after changes constitutes acceptance.
